Subletting
In order to sublet the premises, you must always obtain written permission from the landlord.
It's important to note that the subtenant does not have a contractual relationship with the landlord, and it is the primary tenant who is the landlord to the subtenant. The primary tenant remains fully responsible for the premises throughout the sublease period. This means they are responsible for rent payments, any disturbances, and damages that occur in the premises.
A subtenant must conduct the same activities as permitted in the primary lease agreement.
Transfer of Lease
According to the tenancy act, the premises must have been rented for at least 3 years to have the right to transfer it. If the premises have been rented for less than 3 years, there must be exceptional reasons to allow the transfer.
The person taking over the lease must also take over your business. The premises are transferred as-is, and the new tenant assumes responsibility for the restoration obligation as agreed in the contract.
The tenant is not allowed to transfer the premises without the landlord's written approval.
